Will the owners of the commercial parcels pay assessments for shared common areas with Briar Chapel, such as landscaping and greenways along Briar Chapel Parkway?
Yes. There will be a commercial association with its own set of governing documents that will be completely seperate from the residential association. The commercial association's CC&Rs will state certain obligations to share in costs incurred by the residential association in maintaining certain community features that also benefit the commercial properties, such as landscaping, streetscape improvements, maintenance of monumentations, and such.

Will there be a paved pathway/sidewalk on Briar Chapel Parkway, leading up the retail/commercial area at the entrance?
No, at least not at the Developer's expense. There is a nature path and a mountain biking trail already in place as part of the extensive trail system, with a number of access and exit points, including the commercial areas at the main entrance.

There is such a beautiful waterfall feature as you cross over the bridge entering the community. What happened to the waterfall?
The waterfall has been shut down for an extended period of time. Due to the active home construction nearby, sediment tends to run off from those areas and into the pond which then circulate through the pumps for the waterfall, routinely causing damage. While the waterfall could be turned on we believe the current benefit does not exceed the cost of frequent and repetitive repairs to the pumps.

Who do I contact if I see a common area irrigation leak or irrigation that is running nonstop?
Contact the Association office at 919.240.4959. Please be prepared to give an accurate description of the location of the issue.  Note the street and the closest house/intersection if applicable.

Will the developer consider a second swimming pool as the community grows?
No. Briar Chapel has *2* pools; the activities pool with slides and diving board and a lap pool. Briar Chapel is an amenity-focused community, offering passive and active parks, trails, bocci ball, horse-shoes, community gardens, the Great Meadow and the sportplex pavilion opening in 2016.

What hours are construction contractors allowed to work during the week? Are they allowed to work on the weekend as well?
Contractors are allowed to work from 7 a.m. to 9 p.m. on Monday – Saturday and 8 a.m. to 7 p.m. on Sundays in conjunction with Chatham County Noise Ordinance. Homeowners are encouraged to report any violations witnessed to HOA management at hoa@briarchapellife.com or 919-240-4959.
